MALAS PLUS REWARDS PROGRAMME RULES

PLEASE READ THESE PROGRAMME RULES CAREFULLY TO FAMILIARISE YOURSELF WITH THE BASIS UPON WHICH BENEFITS AND REWARDS MAY BE EARNED, AWARDED, REDEEMED OR EXPIRED.

  1. DEFINITIONS

Unless inconsistent with the context, the expressions set forth below shall bear the following meanings: 

1.1 ‘CPA’ means the Consumer Protection Act, 68 of 2008. 

1.2 ‘Fraudulent Transaction’ means any transaction which, in terms of the laws of the Republic of South Africa, would constitute fraud. 

1.3 ‘Good Standing’ means that you are not in breach of any of your obligations towards us, whatsoever. 

1.4 ‘Malas/Our/Us/We’ - means Malas (Pty) Ltd, a private South African company with registration number 1998/007342/07 and with registered address at 37 Visagie Street, C/o Kgosi Mampuru Street, Pretoria, GAUTENG and reference to ‘Malas’ or ‘our’ or ‘us’ or ‘we’ includes all of our affiliates, associates, subsidiaries and respective divisions. 

1.5 ‘Malas Help Desk’ means our call centre which can be contacted for any queries or assistance during operating hours. 

1.6 ‘Products’ mean those products and services that Malas offers to its customers and by the purchasing of which Members procure and receive MPR Points as determined by the Rules. The Products are also identified on the Website and may vary from time to time. 

1.7 ‘MPR Account’ means the account that reflects your MPR Points. 

1.8 ‘MPR Points’ means the rewards points that you earn when you purchase Products as a Member of the Malas Plus Rewards Programme, which points you become eligible to Redeem. 

1.9 ‘MPR Tier Level’ means the respective Standard or Premium status of the Default Scheme for which you can qualify in the manner as set out in the Rules. 

1.10 ‘Malas Plus Rewards Programme’ means our loyalty programme by means of which Members can collect MPR Points by purchasing the Products and access Benefits as set out herein. 

1.11 ‘Rewards Shop’ means the store on the Malas website offering items, other than the Products, for sale to Members. 

1.12 ‘Member/s/You/Your/Customer’ means customers of Malas who registered for the Malas Plus Rewards Programme and who was allocated an MPR Account. 

1.13 ‘Redeem’ means when you use your MPR Points to pay for the Products or purchase items from the Rewards Shop. 

1.14 ‘MPR Schemes’ means membership to the Default Scheme or a Customer Category scheme within the Malas Plus Rewards Programme for which you can qualify subject to meeting the criteria of such scheme. 

1.15 ‘Default Scheme’ means the general scheme in the Malas Plus Rewards Programme for which membership is automatic.   

1.16 ‘Customer Category Scheme’ means schemes categorised by Customer Groups or Customer Types in the Malas Plus Rewards Programme for which you are eligible to qualify, subject to meeting the criteria of the specific type of scheme. 

1.17 ‘Benefits’ means all or any privileges such as free services, offerings, cashbacks, promotions, re-imbursements and/or allowances in any form or type, whether instant or after membership registration. 

1.18 ‘Exclusive Discount’ means a discount on the value of the Product, and in the discretion of Malas, at a rate which is specific to any one or more of the schemes, for Products or Product Groups, for a certain period, season, or a duration, and that which can be applied as a discount on the invoice or applied as a cashback value on the invoice. 

These terms and conditions of the Malas Plus Rewards Programme Rules are subject to the provisions of the CPA. In the event of any conflict between the terms hereof and the provisions of the CPA, then the provisions of the CPA shall prevail, and any conflicting provision hereof will be severed from these Terms and Conditions and the remainder hereof will remain in force and effect.

  1. MALAS PLUS REWARDS PROGRAMME

2.1 Membership to the Malas Plus Rewards Programme is completely free. 

2.2 Membership to the Default Scheme of the Malas Plus Rewards Programme is automatic when you purchase Products from us. 

2.3 Membership to the Customer Category Scheme of the Malas Plus Rewards Programme is automatic when you purchase Products from us, subject to meeting the qualifying criteria for the specific type of scheme. 

2.4 Rules, criteria, and any terms of the MPR Tier Level, Default Scheme or Customer Category Scheme, MPR Points and Benefits are as presented, and are subject to all the Terms and Conditions contained in these Programme Rules. 

2.5 Qualifying criteria for the Customer Category Scheme are as follows;

  • Pensioner
    • You must be 60 years and older.
    • Proof of identification must be provided for a copy to made and kept on record.
  • Student
    • You must be a registered full time or part time student at any of the accredited universities, colleges or educational institutions in South Africa.
    • Proof of registration must be provided annually for a copy to made and kept on record.
    • This membership applies to students between the age group of 18 to 28 years old.
  • Handyman
    • You must be a handyman business such as an electrician, plumber, painter, carpenter or any other building industry related service provider.
    • You must be an officially registered business in South Africa.
    • A copy of your company/business registration must be provided to be kept on record.
  • E-Hailing
    • You must be registered with an official E-hailing Services Platform.
    • A copy of the license and/or your valid driving permit (PDP)

2.6 MPR Points will be forfeited within 12 months and all Benefits will be cancelled within 24 months if no activity is made on your MPR Account in respect of membership for any of the Customer Category Schemes.   

  1. MALAS PLUS REWARDS POINTS

3.1 Once you become a Member, you will earn MPR Points every time that you purchase Products. 

3.2 You will earn 1 (one) single MPR Point for every R50 that you spend towards any Products purchase or part thereof. 

3.3 Each MPR Point is worth R1 (One Rand). 

3.4 As you purchase Products your MPR Points will accrue and be reflected on your invoices. 

3.5 You may Redeem your MPR Points as a payment tender when you purchase Products. 

3.6 You may also Redeem your MPR Points towards the purchase of any item available on the Rewards Shop. 

3.7 When you Redeem your MPR Points then we will process that particular transaction against your available balance on your MPR Account. You will not be able to spend more MPR Points than the balance or remaining value of the MPR Points present at that stage in your MPR Account. 

3.8 Your MPR Points are earned with every purchase you make and will be valid for a period of 12 (twelve) months from the date on which those MPR Points were earned, after which those MPR Points will automatically expire. To avoid that you forfeit any MPR Points, you must Redeem your MPR Points within 12 (twelve) months from the date upon which you earned and collected it. 

3.9 Your MPR Points are allocated to you personally and are not transferable to another person or entity. 

3.10 The MPR Points cannot be substituted, exchanged or redeemed for cash refunds and will not be carried forward after expiry as specified in clause 3.8. 

3.11 It is the responsibility of the Member to provide their membership number to earn points in their respective MPR Account when purchasing Products. 

3.12 To redeem your MPR Points as a payment tender, you are required to present proof of identification to confirm your membership credentials in order to successfully spend MPR Points as a payment tender. WE WILL NOT ACCEPT MPR POINTS AS A PAYMENT TENDER WITHOUT PROOF OF IDENTIFICATION AS CONFIRMATION OF MEMEBERSHIP UNDER ANY CIRCUMSTANCES. 

  1. MALAS PLUS REWARDS TIER LEVEL AND BENEFITS

4.1 Depending on the amount of MPR Points you accumulate, you will achieve a certain tier status on the MPR Tier Level, that will render you eligible for increased Benefits as provided for in clause 4.3, and 4.4. 

4.2 To retain your tier status, you must maintain the relevant number of MPR Points, as provided for in clause 4.3, and 4.4, at the anniversary of that tier status. 

4.3 Membership to the Default Scheme of the Malas Plus Rewards Programme is automatic when you purchase Products from us. You automatically achieve a MPR Tier Level of ‘Standard Status’. You will retain the Standard Status until such time you are able to upgrade to the Premium Status by meeting the criteria of the Premium Status. If you have Standard Status, you will qualify for the following Benefits: 

4.3.1 One (1) free nitrogen refill per year as offered at the Malas Superstore; 

4.3.2 One (1) free tyre rotation per year as offered at the Malas Superstore; 

4.3.3 A discount on wheel alignment as offered at the Malas Superstore; 

4.3.4 A discount voucher for foods and beverages as offered at the Malas Superstore. 

4.4 Once you have accumulated 400 (four hundred) MPR Points you will achieve a MPR Tier Level of ‘Premium Status’ in the Default Scheme. You will retain Premium Status for a maximum period of 12 (twelve) months. Should you maintain a minimum of 400 (four hundred) MPR Points on the anniversary date, you will retain the Premium Status for another period of 12 months. If you have Premium Status, you will qualify for the following Benefits: 

4.4.1 Three (3) free nitrogen refills per year as offered at the Malas Superstore; 

4.4.2 Three (3) free tyre rotations per year as offered at the Malas Superstore; 

4.4.3 A discount on wheel alignment as offered at the Malas Superstore; 

4.4.4 A discount voucher for foods and beverages as offered at the Malas Superstore; 

4.4.5 A points bonus of 10% more for every MPR Point earned whilst on Premium Status. 

4.5 You are eligible to become a member of a specific Customer Category Scheme in the Malas Plus Rewards Programme, subject to meeting the qualifying criteria of the specific type of scheme. Membership to any of the Customer Category Schemes is permanent and unchangeable. If you have membership with a Customer Category Scheme, you will qualify for the following Benefits: 

4.5.1 One (1) free nitrogen refill per year as offered at the Malas Superstore; 

4.5.2 One (1) free tyre rotation per year as offered at the Malas Superstore; 

4.5.3 A discount on all labour and services as offered at the Malas Superstore; 

4.5.4 A discount voucher for foods and beverages as offered at the Malas Superstore; 

4.5.5 Exclusive Discount as a cashback on the value of certain Products as specified for a specific Customer Category Scheme. Exclusive Discount offers DO NOT apply to Products that are excluded or that are already on promotion. 

4.6 In respect of the Default Scheme, you will receive the MPR Tier Level status based on the level of MPR Points available on the MPR Account on every anniversary date of your membership as stated in paragraph 4. 

  1. RETURNS & REFUNDS

5.1 Should you lawfully cancel any purchase transaction or return any Product for a refund, your MPR Points that you earned towards such transaction will be reversed accordingly. Should you already have Redeemed your MPR Points in any way whatsoever, such redemption will also be set-off against your refund. 

5.2 Additionally, any Benefits accrued from the original purchase transaction will also be reversed in the event of a cancellation of any purchase transaction or return of any Product for a refund.  

5.3 Should any transaction be refunded to you for whatever reason, we will also refund any MPR Points that you Redeemed towards that respective transaction. 

  1. MALAS PLUS REWARDS ACCOUNT

6.1 You may contact the Malas Help Desk during operational hours and request a statement of your MPR Account to view your balance of MPR Points or the complete transaction list. 

6.2 Your MPR Account statement will also be available on your personal profile and can be retrieved from any of our sales personnel. Your MPR Account statement will provide a detailed breakdown of all your transactions that for which you earned and Redeemed your MPR Points. 

  1. MEMBERSHIP CANCELLATION

7.1 You may cancel your membership at any stage by contacting the Malas Help Desk. It is important to note that you must Redeem your MPR Points before you cancel your membership because any MPR Points that are not Redeemed at date of cancellation will be forfeited. 

7.2 Malas in its sole discretion reserves the right to revoke a Member from the Malas Plus Rewards Programme. Where the Member is revoked, all Benefits will be cancelled, and all points or any other Benefits accrued to the date of deactivation will be forfeited. 

7.3 Should you: 

7.3.1 Engage in a Fraudulent Transaction; or 

7.3.2 Breach any of our standard trading terms and conditions; or 

7.3.3 Breach any of the Malas Plus Rewards Programme Rules contained herein; or 

7.3.4 Payment default and/or any account irregularities; or 

7.3.5 Misrepresentation or incorrect personal information; or 

7.3.6 No longer be in Good Standing with us, 

we will automatically cancel your membership and all MPR Points that are not Redeemed at that stage and all Benefits will be cancelled and forfeited with immediate effect. 

  1. WEBSITE

8.1 Once you are registered as a Malas Plus Rewards Member, you can access your Member profile as per the instructions provided. 

8.2 Details of Benefits for any or all MPR Schemes are as listed in the company website (www.malas.co.za) under the Loyalty Program section.    

  1. CPA

9.1 The Products bought with MPR Points will be supplied in the same manner and will be subject to the same terms and conditions as if it were bought by any other form of consideration or acceptable legal tender. 

9.2 The Products bought with MPR Points will also be of the exact same quality as if it were bought by any other form of consideration or acceptable legal tender. 

9.3 Malas reserves the right to impose a partial or complete restriction on the availability of any of the Products to be bought by MPR Points for which Malas will give you prior written notice of no less than 20 (twenty) days before the limitation thereof. 

  1. LIABILITY FOR TAXES

You are solely responsible for any taxes that may be payable or may fall due as a result of any MPR Points that you have collected from us, or may become eligible for, if and where applicable. You hereby expressly acknowledge and agree that we are not responsible, whatsoever, or howsoever, for any loss, damage or costs that you may incur, as a result of you becoming liable for any taxes as a result of your utilisation or participating in the Malas Plus Rewards Programme and/or receipt of any MPR Points. 

  1. RESERVATION OF MALAS’ RIGHTS

11.1 In our sole discretion, Malas reserves the right to change, terminate or cancel the Malas Plus Rewards Programme, partially or fully, or amend or vary the terms of any aspect thereof at any time, which changes Malas will duly communicate to you. 

11.2 Should any MPR Points be incorrectly allocated then we reserve the right to reverse any such incorrect allocation of your MPR Points and this will result in an account debit on your MPR Account. If this should result in a debit balance on your MPR Account, you will be obliged to pay the value of the redeemable points necessary to reinstate your MPR Account to a zero balance. 

11.3 The rules as stated herein are subject to Malas Trading Terms and Conditions. 

11.4 Malas is not responsible for any loss or damage incurred by a Member in any manner whatsoever as a result of participation in the Malas Plus Rewards Programme. 

11.5 Malas decision is final in every situation, including any not covered herein. No correspondence will be entered into, and Malas reserves its rights in all instances. 

  1. PERSONAL INFORMATION

12.1 The personal information you provide during registration is purely for security and communication purposes. 

12.2 To redeem your MPR Points as a payment tender, you are required to present proof of identification to confirm your membership credentials. WE WILL NOT ACCEPT MPR POINTS AS A PAYMENT TENDER WITHOUT PROOF OF IDENTIFICATION AS CONFIRMATION OF MEMEBERSHIP UNDER ANY CIRCUMSTANCES.   

12.3 We will not violate your privacy and will always keep this information secure. 

12.4 You consent to receiving communications, marketing materials and related information in respect of the Malas Plus Rewards Programme. 

12.5 Ultimately these forms of communication are used in order to enhance our customer service and marketing initiatives. If you wish to no longer receive correspondence, you will be able to opt out from our communication. 

12.6 If your contact details change, please do inform us so that you can continue to receive the necessary communication and we can continue to provide the best possible service to you. We cannot be held responsible for misinformation if incorrect contact details are provided to us nor when contact details are not updated timeously.

  1. PERSONALISED CUSTOMER EXPERIENCE

13.1 We strive to provide you with the most enjoyable and relevant shopping experience possible. 

13.2 We encourage you to keep your Malas Plus Rewards Membership purely for your own personal use and discourage sharing your membership with friends and family. This way we can ensure that our communication is ultimately tailored to your needs and preferences specifically and not those of others. 

13.3 We create and customise Benefits just for our customers, providing personalised and relevant communication with clearly thought out offerings and pertinent savings, just for you.  

13.4 Malas accepts no responsibility for loss, damage or exploitation of Membership borrowed or shared amongst customers, in addition to the possible receiving of unnecessary and irrelevant communication.  

Please note that the terms and conditions as stipulated in this Malas Plus Rewards Programme Rules are subject to change by Malas without prior notice. This includes, and is not restricted to, any aspect of the programme, whether it be the value of the MPR Point, Tier Level criteria, Default Scheme or Customer Category Scheme criteria, Benefits, or any other terms & conditions.
